Monumental Expeditions and Safaris Terms and Conditions.

1) When a client indicates that he accepts a reservation, he is acting on behalf of himself and any individuals under his supervision; therefore, everyone is subject to the terms of the reservation as though they had submitted the application on their own. No one has the ability to change any of the applicable terms and conditions on behalf of Monumental Expeditions and Safaris (henceforth referred to as “the Company”), with whom all reservations are made.

2) The client has seen that the terms of the company include a 20% non-refundable deposit for ground arrangements and full payment for any chimpanzee or gorilla permits for each individual at the time of booking. The safari’s total cost, excluding permits and airfare, includes this booking fee. These terms shall be applicable to the client after a reservation has been confirmed (at the agent’s request).

3) The client must pay the whole amount owed to the company at least four weeks before the departure date. Reservations booked less than four weeks prior to the departure date need full payment at the time of booking.

4) In the event that a reservation is canceled, the following will be applicable in addition to any cancellation fees that the airline may impose and for which the customer is responsible: The company will keep the entire deposit, but any money over that will be returned to the customer (with the exception of any flights that would be considered non-refundable and gorilla or chimp permits). Less than 30 days prior to departure, the company will keep the entire deposit and charge a cancellation fee equal to 40% of the land arrangements plus the full cost of any airfare that would be considered non-refundable as well as any gorilla or chimp permits. fewer than twenty days before departure The full deposit will be kept by the company, and a cancellation fee equal to 65% of the land arrangement plus the full cost of the airline ticket, gorilla permit, and chimp permit will be due. 15 days or less before departure The full deposit will be kept by the company, and a cancellation fee equal to 100% of the total cost of the trip will be charged. Any tour or product sold before departure may be canceled by the company at any time. In such a case, the client will not have any further claims of any kind against the company and the company will be required to reimburse all money received by the client (with the exception of gorilla and chimpanzee permits and any air portion, which are non-refundable).

5) If a customer does not participate in a tour or does not utilize the lodging or services that the company has reserved for them, for any reason, there will be no reimbursement or responsibility if the lodging or excursion is not accessible or the customer is unable to utilize that service.Without limiting the generality of the aforementioned, the company and any individual acting for, through, or on behalf of the company shall not be liable for any loss or damage resulting from any cause whatsoever. In particular, they shall not be held accountable for any loss or damage resulting from any errors or omissions contained in their brochure or other literature, late or non-confirmation of booking acceptance, loss or damage caused by delays, illness, injury, or death, whether or not these events were caused by negligence. If weather, avalanches, strikes, war, government interference, or any other reason renders a tour impossible, illegal, or unwise, the passenger is responsible for any additional costs incurred. Additionally, the company has the right to cancel any tour or the remaining portion of it, or to change the itinerary, accommodations, price, or other details. We reserve the right to cancel any tour or product that has been sold before departure, and in that case, we will be required to reimburse the passenger for all money received up to that point. The passenger will not have any further claims of any kind against the company as a result of the cancellation.

6) All reservations made through Monumental Expeditions and Safaris must include cancellation, curtailment, default, medical, and repatriation insurance; it is the client’s obligation to make these arrangements. It is highly advised that clients purchase insurance to cover lost luggage, emergency travel and lodging, and any additional coverage they think appropriate. The client alone is in charge of choosing the insurance coverage they get, aside from mandatory insurance.

7) The client agrees that the company may occasionally alter the itinerary without giving either the agent or the client advance notice, as long as the price and itinerary do not significantly differ from the one the client had hoped to enjoy. The client or agent will not be able to terminate the agreement. Increases in airline tariffs, fuel prices, game reserve fees, and exchange rate fluctuations are some of the reasons why fares may rise. The company retains the right to recalculate the safari’s cost and impose a penalty if the group size is less than the minimum number needed for the reservation as stated in the booking confirmation. The company retains the right to cancel the tour and keep the whole amount if any clients or agents refuse to accept and pay the premium.

8) Although the company tries its best to keep to schedules, it should be remembered that it has the right—and is sometimes required—to alter safari routes and camps in response to unforeseen circumstances.

9) The client agrees that it is entirely his or her duty to make sure that he or she has all the travel documents that may be needed for the suggested tour and itinerary, as well as any health and other certificates that may occasionally be needed. Monumental Expeditions and Safaris will make an effort to help the client, but this will be at Monumental Expeditions and Safaris’ sole discretion. The client agrees that Monumental Expeditions and Safaris is not taking on any responsibility or liability in this regard, and that the client will hold Monumental Expeditions and Safaris harmless from any repercussions of non-compliance.

10) Monumental Expeditions and Safaris will make an effort to help the client with point 9, but this will be at the company’s discretion. The client understands that by doing this, the company is not taking on any responsibility or liability, and that it is still their responsibility to make sure the aforementioned documents are in order and comply with all legal and other requirements so they can benefit from the tour.

11) It is noted that the contract may include a tour or journey to an area or areas where the client may be in danger, and as a crucial component of these terms, the agent and client have agreed to sign a waiver of claims against Monumental Expeditions and Safaris, its principals, and others. The client (which will be interpreted to include the client’s heirs, executors, administrators, or assigns) hereby irrevocably waives and gives up any and all rights that the client may have against the company in the event that the client suffers any kind of loss, damage, injury, death, or other consequence, whether directly or indirectly, as a result of any act of omission or commission by Monumental Expeditions and Safaris or others, following the conclusion of the contract and the client’s participation in the tour or journey specified in the contract (which will include these terms and the Booking Confirmation). In keeping with the aforementioned, the client and agent hereby release, indemnify, and hold harmless Monumental Expeditions and Safaris, its principals, or anyone from any and all claims that the client may have as stated, regardless of their nature or how they may arise.

12) The customer pledges that he or she will always abide by the company’s or others’ rules about behavior and that he or she will not in any way harass any other tour participants. The client guarantees that he or she is able to bind each member to the conditions of the contract when traveling with others under their supervision.

13) The client agrees that, even with the best efforts, he is ultimately responsible for taking care of his personal belongings and, if necessary, obtaining travel insurance. Any losses or damages that may arise while on safari will not be covered by the company.

14) The company offers travel and/or other services to customers, either directly or through agents for companies involved in or connected to the travel sector, including airlines, other ground handlers, lodges, camps, etc. The company only acts as an agent for these principals, and as such, it disclaims all liability for any loss, damage, injury, or death that a client may experience due to any action or inaction on the part of these principals or their failure to carry out their responsibilities, whether they be related to travel, lodging, or other matters. The only agreement between the principal and the customer is the one that these principals utilize, which is frequently represented by the ticket or voucher that the principal issues. The client’s only recourse will be against the principal. The company maintains the right to raise the tour prices in response to any rise in fuel prices, game reserve fees, airline tariffs, or exchange rate fluctuations.

15) Unless a claim is the result of the company’s egregious negligence and is submitted in writing to the company within 30 (thirty) days following the conclusion of the tour, the company will never be held accountable for any kind of claim. The Company will never be responsible for any indirect or consequential loss or damage, and such liability shall be limited to USD 2000.00 per client.

16) Written complaints about the tour must be submitted within 21 days after the tour’s conclusion.

17) The parties’ relationship is governed by these terms in their entirety. The client understands that he or she has not relied on any matter or thing stated on behalf of the company or otherwise that is not included herein, and that there are no other terms, conditions, warranties, representations, guarantees, promises, undertakings, or inducements of any kind governing the relationship. The client-Monumental Expeditions and Safaris relationship will be governed by Ugandan law.
